Based on Article 291 of the Criminal Procedure Code the Minister of Justice is entitled to send a written order to the Director of Public Prosecutions asking to display a dossier fora lawsuit filed on the Supreme Court for the occurrence of conduct which is contrary to the law, or a decision which is contrary to the law and the judgment or decision became final; and the Supreme Court never audited the procedure, ruling, or the contested decision.

Conditions for obtaining service

A petition submitted to the Minister of Justice accompanied by peremptory judicial decisions and any predicates supporting the application for retrial; and payment of legal fee.

Procedures

- Obtain duly certified court ruling.

- Payment of legal fees, if any, in accordance with the court fees code No. 43 of 2005 and the court fees schedule attached thereto.

- Submit the petition stating the reasons and justifications of the request.
